Terms and Conditions for CHALICE iOS and Android App

These terms and conditions (“Terms”) govern your use of the CHALICE mobile application (“App”) provided by Jean Roorda. By downloading, installing, or using the CHALICE App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

1. Scope of Services

The CHALICE App provides a place for spiritual growth, healing and learning sanctuary for awakening souls, a portal to a library of guided clairvoyant meditations, and a community of healers practicing clairvoyant meditation to deepen their awareness, intuition and Spiritual growth. Create account, then access recorded meditation classes via the lower bar tabs “Courses” and “Lessons”. Browse for free and paid courses, with option to download on phone for future use. Start with the Foundation Series. Access live clairvoyant meditations and training via the “Live” tab on lower bar, and connect with other healers and students on CHALICE via the “Community” tab on lower bar, which takes you to a chat communication area. Chat directly with teacher and creator, Jean Roorda, via the “Chat” tab, or “Book a Private Reading” under the “Settings” tab on lower navigation bar.

Experience the support and encouragement of access to meditations and communication with others on the path of awareness and intuitive wisdom. Access meditations via individual Lessons, Courses with multiple lessons, or join Live meditations. Lessons are paid for individually. Various Courses are available with both free and paid options. Access to Live Meditations is available as a one time payment each time, or by subscription. A monthly subscription gives you access to all live meditations occurring within the next 30 days. A quarterly subscription gives to access to all live meditations occurring within the next 90 days. Upon confirming your initial subscription purchase, payment will be automatically deducted from your linked iTunes Account. Subscriptions renew automatically, unless you opt to turn off auto-renewal at least 24 hours before the current subscription period ends. Your account will be charged for renewal within 24 hours before the current period ends, with the renewal cost specified. Easily manage your subscription and disable auto-renewal by accessing your Account Settings post-purchase. Purchase of any Lesson, Course, Live Meditation or Subscription gives you access to the Community page, a group message, content share, comment and discussion board.

The Company reserves the right to modify, suspend, or discontinue any aspect of the App at any time without prior notice.

2. User Accounts

a. Registration: To use certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

b. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breaches.

3. User Conduct

a. Prohibited Actions: You agree not to:

    • Violate any applicable laws or regulations.

    • Use the App for any unlawful or unauthorized purpose.

    • Engage in any activity that disrupts, interferes with, or harms the functioning of the App.
    • It is important to be in an appropriate space when meditating. Do not be driving, operating machinery, doing anything that would be distracting you from the deep inward space you are entering. Sit down in a chair, upright but relaxed, with feet on the floor, eyes closed, in a space that is as quiet and free of distractions as possible.
    • It is important for the benefit of yourself and others that you maintain a substance-free life in order to participate in the meditations, both live and recorded. The amount of energy interference you and others will experience from drugs, alcohol, plant medicine etc is not conducive to developing and furthering embodied awareness, growth, transformation and ownership of your body-mind. If you are struggling with ending a pattern of substance use and would like support, please seek appropriate counseling. If you have questions, please contact Jean.
    • If you are working through severe physical trauma and/or abuse, please consider somatic therapy in addition to the healing work offered here.

b. Content: You are solely responsible for any content you post, transmit, or share through the App. The Company does not claim ownership of user-generated content but may use, modify, or distribute it for the operation and improvement of the App.

4. Privacy

a. Privacy Policy: Your use of the App is also governed by our Privacy Policy.  By using the App, you consent to the collection, use, and sharing of information as described in the Privacy Policy.

5. Intellectual Property

a. Ownership: All rights, title, and interest in and to the App and its content, including but not limited to trademarks, copyrights, and other intellectual property rights, are owned by or licensed to the Company.

b. Use Restrictions: You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App.

6. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

7. Limitation of Liability

In no event shall the Company, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Oregon in the United States of America, without regard to its conflict of law principles.

9. Changes to Terms

The Company reserves the right to update or modify these Terms at any time. Continued use of the App after such changes constitutes your acceptance of the revised Terms.

11. Purchases

a. In-App Purchases: The CHALICE App may offer certain products, services, or features available for purchase within the application (“In-App Purchases”). By making an In-App Purchase, you agree to pay the specified fees and charges applicable to that purchase.

b. Auto-Renewable Subscriptions:

  • Types and Billing: CHALICE offers 1-month and 3-month subscriptions, billed to your Apple ID at confirmation of purchase and automatically renewing unless turned off 24 hours before the end of the current period.
  • Renewal Charges: Charged within 24 hours prior to the end of the current period at the specified rate.
  • Management: Manage and turn off auto-renewal in your Apple ID account settings.
  • Cancellations and Refunds: Cancel anytime through account settings; cancellations take effect at the end of the current period. Refunds are subject to Apple’s policies.

c. Payment Information: You agree to provide accurate and complete payment information for all purchases made through the App. You represent and warrant that you have the legal right to use the payment method provided.

d. Billing and Cancellation: Payments for In-App Purchases are non-refundable except as required by applicable laws. You are responsible for all charges incurred under your account, including applicable taxes. We reserve the right to change our prices and fees at any time.

e. Third-Party Platforms: In-App Purchases may be processed through third-party platforms (e.g., Apple App Store, Google Play Store). Your purchases through these platforms are subject to their terms and conditions, and the Company is not responsible for any actions or policies of these third-party providers.

f. Delivery of Goods or Services: Upon completing a valid purchase, the Company will use commercially reasonable efforts to ensure delivery of the purchased goods or services within a reasonable time frame and in accordance with the description provided.

g. Errors and Disputes: If you believe there has been an error in any charge relating to your In-App Purchase, please contact us promptly to address the issue.
